TERMS AND CONDITIONS
BOOKING
In case you want to make a reservation, you can do it through our website or by going to one of our offices in person.
To make the reservation via the web, you must access https://kanela.net/reservas/
Reservation: …from your cart use the coupon “reservation” and proceed to “checkout” to pay 20% of the total. The remaining 80% can be paid at our offices in cash or by card, before your activities take place.
Pay in full: …from your cart proceed to “checkout” to pay the full amount for your activities.
If you want a specific date and time, you must contact us by phone in advance to check availability.
If you wish to reserve the activity at one of our offices, we will complete your registration there and you must pay at least 20%.
CANCELLATION TERMS
CANCELLATION BY THE CLIENT:
With more than 15 days in advance: cost 5%
Between 5 and 10 days in advance: cost 10%
Less than 5 days in advance: cost 20%
The full amount will only be refunded for some physical or accidental problem that prevents carrying out the activity, and properly justified
CANCELLATION BY THE SCHOOL
In case the activity is canceled due to adverse weather conditions or any unforeseen issue with the equipment, an alternative date will be sought.
If an alternative date cannot be found by either party, the full amount for the part of the activity not carried out will be refunded.
GENERAL CONDITIONS
The enrolled individuals (or the responsible guardian in the case of minors) declare that they are in good physical shape and health, that they are familiar with the activity and the risks involved in performing it, releasing the Club de Vela Sotavento from full responsibility as the organizing entity of the activities, as well as Torrecantil, S.L. as the owner of the equipment. The center reserves the right to cancel the activity if it considers that the person is not in optimal condition to carry it out, and as a consequence, they would lose the day of the activity. Likewise, they agree to respect and follow the instructions of the instructors during the activity. They also declare that they know how to swim.
The Sotavento Sailing Club, in compliance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, informs you that the personal data you provide will be included and processed in our files owned by the Sotavento Sailing Club, whose purpose is the maintenance and fulfillment of the relationship with the Sotavento Sailing Club, as well as the sending of communications and advertising by any means (electronic, postal, telephone). I authorize the Sotavento Sailing Club to send an email to Tripadvisor in order to receive an email requesting to provide an opinion about the experience.
In compliance with the LOPD, you may exercise the right of access, rectification, opposition, and cancellation of your data before the Club de Vela Sotavento, for which you must send us your request via the email kanela@kanela.net.
Participants in the authorized nautical activities authorize the Club de Vela Sotavento to obtain and publish their image within the context of the nautical activity, both in print and digital formats, as well as on the website and social media of the Club's commercial brand called "Kanela Sailing School," provided that the images do not involve unlawful intrusion into privacy, honor, or reputation, or are contrary to their interests.
RULES FOR USERS OF KANELA SAILING SCHOOL
TOBACCO. According to Law 42/2010 on tobacco consumption, smoking is prohibited in sports facilities.
DOGS. The possession of dogs on the beach is not allowed, and therefore in our facilities either.
*The club is exempt from any liability for improper use of the equipment as well as in the event of an environmental disaster such as a storm, hurricane winds, flood, fire...
*The Club will not be responsible for any theft or loss of personal belongings occurring in the Club's facilities.
*The club will not be responsible in any case for the loss or damage of personal belongings during activities in the sea. It is recommended not to bring any electronic devices.
*In the case of renting a dinghy or catamaran, where it is recommended to carry a mobile phone for safety, the club indicates to carry the phone in a waterproof case inside a dry bag and not to handle it in any situation other than an emergency. The club will only be responsible for the phone if it is due to a defect in the waterproof cases and if the use is justified by an emergency.
*The client agrees to pay for any damage caused to the club's equipment, facilities, and staff due to their own negligence.
REQUIREMENTS TO CARRY OUT NAUTICAL ACTIVITIES
*Knowing how to swim.
*The use of life jackets is mandatory at all times.
*Being in good physical condition and health, knowing the activity they are going to perform and the risks involved, fully exonerating the Club as the organizing entity of the activities from responsibility for damages caused by their own negligence. The center reserves the right to cancel the activity if it considers that any person is not in optimal conditions to perform it.
*Respecting and following the instructions of the instructors during the activity and while on the premises.
*Being responsible for any damages they may cause to third parties, or to the rented equipment, due to their own negligence.
*Respecting basic navigation rules such as: sailing outside the swimming area, or entering and leaving through the boat entry and exit calmly without exceeding a speed of 3 knots.
CONTRACTED ACTIVITIES
SCHEDULE OF ACTIVITIES
*In case an activity is delayed by the club (whether due to previous clients being late, adverse conditions, or equipment maintenance), the contracted time will start counting once the equipment is prepared and available.
*If the equipment and instructor are ready at the scheduled time, the activity time will start counting from that time. A delay on the part of the client will not affect the scheduled end time, and the delay time is considered valid. The activity begins with the preparation of the equipment and ends when the equipment is put away.
*It will also be considered as started from the agreed start time, since the instructor will already be changed and ready for the class with the equipment prepared.
CONDITIONS FOR ACTIVITIES WITH INSTRUCTOR
*The use of life jackets is mandatory at all times.
*The use of sunscreen and lycra is recommended.
*The company provides a first aid kit for all users; under no circumstances will the administration of any medication by our staff be included.
*If necessary, Kanela Sailing School will facilitate transportation to the civil protection post in any emergency.
*Throughout the entire activity, rescue service is included and guaranteed.
In the case of it being a group, the responsible signatory will answer all the terms previously stated regarding the members of the group. The group leader declares that the participants are in good physical shape and health, that they are familiar with the activity and the risks involved in performing it, releasing the Sailing Club Sotavento from all responsibility as the organizing entity of the activities as well as Torrecantil S.L. as the owner of the equipment. The center reserves the right to cancel the activity if it considers that the person, or part of the group, is not in optimal condition to carry it out, as a consequence of which they would lose the day of the activity. Likewise, they commit to respecting and following the instructors' guidelines during the activity. They declare that all participants can swim, and in the case of minors, they have written authorization from their parents or guardians to undertake the activity.
RENTING
RENTAL AND MATERIAL VOUCHERS WITHOUT INSTRUCTOR
The lessee ensures that they possess the necessary knowledge and experience to operate the rented vessel and that they are familiar with the basic navigation safety rules, which are available to the lessor. Under no circumstances may the operation of the vessel be delegated to a person other than the one designated in the contract. The LESSEE is obligated solely to carry on board the rented vessel the maximum authorized number of persons, who must at all times wear a life jacket. In the case of material reservation, the reserved time will be counted from the agreed hour, even if the material is not used for any reason.
* Material vouchers cannot be canceled while there are favorable weather conditions for the use of the material, losing their value if the rental hours are not used during the season.
* Full payment of the voucher amount is required before using the material.
* Material vouchers are seasonal. If all hours are not used, they will be lost at the end of the season, and neither a refund of the amount nor the use of unused hours in subsequent seasons can be claimed.
*People who rent nautical equipment are warned that they are responsible for any damage they may cause to third parties, or to the rented equipment itself, due to their own negligence. They must also follow basic navigation rules (available at the office), such as: sailing outside the swimming area or entering and exiting through the boat entry and exit points.
*The sailing school is expressly exempt from liability for improper use of the rented equipment.
*The renter commits to and agrees to pay for any damage caused to the equipment and personnel due to improper use caused by their own negligence.
NAVIGATION AREA FOR RENTALS
* Do not move away under any circumstances more than 1.8 km with a catamaran and inflatable boat, 0.9 km with windsurfing, paddleboarding, kayaking, and pedal boating. You must always remain in direct visual contact with the school; the rescue system will be activated due to your own negligence if you exceed this distance or lose direct visual contact, with all resulting expenses to be borne by the renter.
RESCUE FOR RENTALS
*Rescue due to one's own negligence will have a minimum cost of 35 euros, with an additional 1 euro/minute past the first half hour.
*Rescue by the school will be activated in the following cases: 1. Notification from a family member or friend onshore. 2. If remaining capsized for more than 15 minutes. 3. Clear evidence of lack of knowledge in handling the boat. 4. After 15 minutes past the expected arrival time. 5. If leaving the navigation area planned for the various activities. 6. Lack of wind expected according to the weather report.
*The school's rescue service only covers 2 miles (3.6 km) in all directions. Beyond this distance, emergency services will be notified in all cases, and the client will bear all costs incurred if caused by their own negligence.
PARKING
RULES FOR USERS OF MATERIAL IN PARKING
* Clients with material in parking accept the general rules for users of the school.
* The parking service is seasonal. In case the contracted time is not fully used, it will be forfeited at the end of the season, and neither refunds nor use of the contracted time in subsequent seasons can be claimed.
* The club is exempt from any liability for improper use of the material.
* The club will be responsible for any damage or theft occurring on the Club's premises during the contracted period, except for small items such as harnesses, spare bags, wetsuits...
* The club will not be responsible in the event of environmental disasters such as storms, hurricane-force winds, floods, fires...
LAUNCHING AND LIFTING OF BOATS
* The schedule for launching and lifting with the quad is from 10:00 to 14:00 and from 16:00 to 20:00. Outside of this schedule, boats will not be lifted or launched with the quad. However, the client may use the hauling cart without the quad both inside and outside of this schedule.
* The usual quad service includes only 1 monitor, and the client must help lift and lower the boat from the cart.
* There is a launching service on request, which costs 10 euros/ride + 5 euros for trees (10 if very complex). It must be requested at least two hours in advance.
* In case the service is saturated, courses and school rentals will have priority. It is recommended to choose a time outside of peak hours.
RESCUE
*The activation conditions and cost are the same as those for rental clients.
* The owner of the equipment must notify the Club in case they do not return to the facilities after navigation, taking precautions such as: express notice in case of a long navigation and informing of intentions, having someone aware of the scheduled return time, or carrying a mobile device with water protection to be able to notify. The Club assumes no responsibility during the clients' navigation under parking service, exempting the club from any liability in case any incidents occur during navigation. THE CLUB DOES NOT OFFER SURVEILLANCE SERVICE DURING NAVIGATION.
*In case the vessel does not arrive at the scheduled time or after 8:00 PM without having telephone contact, the school should have in its record how to act. If there are no instructions on how to proceed, it is assumed that it is not desired for the person to be searched for rescue.
DISCOUNTS
*Of the types of discount, only the one that is most favorable will be applied.
* Only the discounts for early bookings and for the number of courses in the same season will be combined.
* To apply a discount, the complete course must be completed, losing (the discount) in case of a refund for not finishing the course.
RULES COVID 19
The school has a Manual of Good Practices available at https://kanela.net/2020/06/09/guia-de-buenas-practicas-kanela-sailing-school-covid19/. It is recommended that all users should be familiar with it before carrying out any type of activity.
The school has a SPECIFIC PLAN FOR MEASURES TO REDUCE CONTAGION BY THE CORONAVIRUS, SARS-CoV-2, in the facilities of Kanela Sailing School, available to all users. It will be available to all users in the offices of the facility.
